These Terms of Service (the “Terms”) set out the conditions for using Diety (the “Service”). By using the Service, you agree to these Terms.

Scope

These Terms apply to the app, website, related features, support, and all other services provided in connection with the Service.

If separate notices, guidelines, help pages, or in-app explanations are provided for the Service, they form part of these Terms.

Account

You must provide accurate and up-to-date information when using the Service. If your registered information changes, please update it promptly.

You are responsible for managing your account, device, and sign-in information. We are not responsible for damages caused by insufficient account management, misuse, errors, or use by a third party, except in cases of our willful misconduct or gross negligence.

Nature of the Service

The Service is designed to help users record weight, body fat percentage, height, notes, and related information, and to support daily health management and habit building.

The Service does not provide medical care, diagnosis, treatment, prevention, nutrition advice, exercise advice, or any other professional medical or health service. Records, graphs, trends, notifications, goals, messages, and other information displayed in the Service are for reference only. We do not guarantee their accuracy, completeness, usefulness, or any particular result.

If you have concerns about your health, or if you are making decisions about weight loss, weight gain, diet, exercise, or treatment, please consult a physician, registered dietitian, or other qualified professional.

Health Information and User Responsibility

You use the Service at your own risk and responsibility, taking into account your health condition, physical condition, and lifestyle.

Values such as weight and body fat percentage may differ from your actual condition due to measuring devices, input methods, Health integrations, communication conditions, sync timing, or other factors. You should not rely solely on information in the Service and should seek professional advice when necessary.

Health Integration and Data Sync

If you grant permission, the Service may integrate with Apple Health or similar health features to read or sync information such as weight, body fat percentage, and height.

Data retrieval, storage, display, and synchronization may be delayed, fail, duplicate, be missing, or be inaccurate due to external services, devices, operating systems, communication environments, permission settings, measuring device specifications, or outages. We are not responsible for damages caused by these issues except in cases of our willful misconduct or gross negligence.

Room Sharing

The Service allows users to create Rooms and invite other users through invite codes or invite links. When you join a Room, shared records, profile information, stamps, notes, messages, and other information may be visible to members of the same Room.

You are responsible for managing invite codes, invite links, and information shared in Rooms, and for carefully deciding who should receive access. Please understand that information shared in a Room may be viewed, saved, forwarded, or captured in screenshots by other members.

Posts and Messages

You are responsible for notes, stamps, messages, and other content you post or share in the Service.

If we determine that content violates laws, these Terms, third-party rights, user safety, or operational requirements, we may review, hide, delete, restrict, or take other necessary measures regarding that content. We are not obligated to monitor all content at all times.

Prohibited Conduct

You must not engage in any of the following conduct when using the Service:

• Violating laws, regulations, public order, or generally accepted standards of decency
• Registering or sending false information
• Impersonating another person or using another person’s account
• Defaming, threatening, harassing, discriminating against, or causing discomfort to other users, us, or third parties
• Publishing or sharing personal information, sensitive information, or health information without the person’s consent
• Posting or sending obscene, violent, discriminatory, illegal, harmful, or nuisance content
• Placing excessive load on the Service’s servers, networks, or systems
• Unauthorized access, reverse engineering, analysis, modification, automation, scraping, vulnerability probing, or other acts that interfere with operation
• Advertising, solicitation, spam, commercial use, or other conduct we deem inappropriate
• Exploiting bugs or defects in the Service for improper purposes
• Any other conduct we deem inappropriate

Account Suspension and Restrictions

If you violate these Terms, are suspected of violating them, or if we determine that action is necessary for operation of the Service, we may, without prior notice, delete posts, restrict features, suspend accounts, delete accounts, remove users from Rooms, or take other necessary measures.

We are not responsible for damages caused by these measures except in cases of our willful misconduct or gross negligence.

Advertising

The Service may display advertisements. Advertisers and other third parties are responsible for the content of advertisements, linked sites, and products or services provided by advertisers. If you interact with an advertisement, you do so at your own judgment and responsibility.

External Services

The Service may use or integrate with external services such as Firebase, Google Analytics for Firebase, Firebase Crashlytics, Google AdMob, Apple Health, operating system notification features, the App Store, Google Play, and other services.

Due to changes in specifications, suspension, outages, data limits, account restrictions, terms changes, communication failures, or other issues involving external services, all or part of the Service may become unavailable or data synchronization may be affected. We are not responsible for damages caused by external services except in cases of our willful misconduct or gross negligence.

Changes or Suspension of the Service

We may change the contents of the Service, add, modify, or discontinue features, or temporarily suspend or terminate the Service when necessary.

We will provide notice in advance or afterward where reasonably possible, but we may make changes or suspend the Service without notice in emergencies, maintenance, outage response, circumstances involving external services, or other unavoidable situations.

Data Backup

You are responsible for backing up your records and important information when necessary. We do not guarantee data storage, restoration, or integrity.

Intellectual Property

Intellectual property rights relating to the app, design, logo, text, images, programs, and other content of the Service belong to us or the relevant rights holders.

As a general rule, you retain rights to content you post or register in the Service. However, you grant us permission to use such content to the extent necessary to provide, display, store, share, improve, troubleshoot, and support the Service.

Disclaimer

We do not guarantee that the Service will meet your particular purpose, produce expected results, operate accurately and continuously, be free of defects, or prevent data loss.

We are not responsible for damages arising from use or inability to use the Service, data errors, loss or synchronization failures, Room sharing, disputes between users, advertisements, or external services, except in cases of our willful misconduct or gross negligence.

Changes to These Terms

We may update these Terms from time to time. If we make important changes, we will notify users through the app, website, or another appropriate method. By continuing to use the Service after the changes take effect, you agree to the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. If a dispute arises in connection with the Service, the Japanese court with jurisdiction over our principal place of business shall be the exclusive court of first instance.
